Virify Limited Acceptable Use Policy

Please read this acceptable use policy carefully before using our site as it forms part of the legally binding agreement between you and Virify Limited.

Definitions

“User Content” means any material, content or other information uploaded, shared, created, generated or posted on our site, including (without limitation) property listings, images, property descriptions, reviews, messages sent via our instant messenger.

What this policy covers and how it applies to you

This acceptable use policy sets out the standards of behaviour and content that apply when you use https://virify.co.uk/ (our site), including when you:

add User Content to our site.
Make contact with other users on our site, including via our instant messenger feature.
Link to our site.
Use our site in any other way.

This policy supplements our Terms and Conditions. Where our Terms and Conditions refer to our Acceptable Use Policy, they mean this document.

By using our site, you confirm that you accept this policy and agree to comply with it. If you do not agree with this policy, you must not use our site.

We recommend that you print a copy of this policy for future reference.

You must comply with this policy in spirit as well as to the letter. We will determine, in our discretion, whether any User Content or your use of our site breaches this policy.

For the avoidance of doubt, this policy applies equally to all users of our site, whether you are a business user or a consumer user.

We may make changes to this policy

We may amend this policy from time to time at our sole discretion. Every time you wish to use our site, please check this policy to ensure you understand the terms that apply at that time.

Prohibited uses of our site

You must not use our site:

In any way that breaches any applicable law or regulation.
In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
For the purpose of harming or attempting to harm minors in any way.
To bully, insult, intimidate or humiliate any person.
To send, knowingly receive, upload, download, share, post, use or re-use any material which does not comply with our content standards set out below.
To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, ransomware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
To misrepresent your identity, your authority to act on behalf of another person, or the nature, detail or characteristics of any property listed on our site.
To use our instant messenger feature for any purpose other than genuine communication relating to property enquiries or transactions facilitated through our site.

Content standards

These content standards apply to all User Content.

User Content must:

Be accurate (where it states facts), and otherwise be to the best of your knowledge.
Only contain opinions that are genuinely held.
Comply with any applicable law.

User Content must not:

Be defamatory of any person.
Be obscene, offensive, hateful or inflammatory.
Be confidential.
Infringe any copyright, database right or trade mark of any other person.
Include material that might impair the physical, mental or moral development of persons under the age of 18.
Be likely to deceive any person.
Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
Contain illegal content or promote any illegal content or activity.
Be in contempt of court.
Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
Be likely to harass, upset, embarrass, alarm or annoy any other person.
Impersonate any person or misrepresent your identity or affiliation with any person.
Give the impression that the User Content emanates from Virify Limited, if this is not the case.
Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
Be pornographic.

Illegal content

In addition to the above, you must not use our site in any way that involves the following:

Terrorism.
Child sexual exploitation or abuse, including grooming and child sexual abuse material.
Hate offences.
Harassment, stalking, making threats or abuse.
Controlling or coercive behaviour.
Intimate image abuse.
Sexual exploitation of adults.
Human trafficking.
Unlawful immigration.
Fraud and financial offences.
Proceeds of crime offences.
Drugs or psychoactive substance offences.
Firearms, knives and other weapons offences.
Encouraging or assisting suicide.
Foreign interference offences.
Animal cruelty.

Content harmful to children

The following must not be created, uploaded, shared or generated on our site:

Pornographic content.
Content which encourages, promotes or provides instructions for suicide.
Content which encourages, promotes or provides instructions for an act of deliberate self-injury.
Content which encourages, promotes or provides instructions for an eating disorder or behaviours associated with an eating disorder.
Content that is abusive and which targets any of the following characteristics: race, religion, sex, sexual orientation, disability, gender reassignment.
Content which incites hatred against people of a particular race, religion (including lack of religion), sex or sexual orientation, or who have a physical or mental disability.
Content which encourages, promotes or provides instructions for an act of serious violence against a person.
Bullying content.
Content which depicts real or realistic serious violence against a person or animal, or depicts the real or realistic serious injury of a person or animal in graphic detail.
Content which encourages, promotes or provides instructions for a challenge or stunt highly likely to result in serious injury to the person who does it or to someone else.
Content which encourages a person to ingest, inject, inhale or in any other way self-administer a physically harmful substance, or a substance in such a quantity as to be physically harmful.

Offences

You must not upload, post, create on our site, share or cause any uploading, posting, creation or sharing of any of the following:

A grossly offensive, indecent, obscene or menacing message intending to cause offence, menace, distress or anxiety.
A false message knowing it to be false, intending to cause non-trivial psychological or physical harm to a likely audience, and with no reasonable excuse.
A message threatening death or serious harm while intending or being reckless as to whether the object of the threat would fear that the threat would be carried out.
Flashing images when it is reasonably foreseeable that an individual with epilepsy will see them and the sender intended that the individual would suffer harm, and the sender has no reasonable excuse for sending the images.
A communication that intends to encourage serious self-harm.
An unsolicited sexual image, including a manufactured intimate image or “deepfake”, intending the recipient to be caused alarm, distress or humiliation, or for the purpose of sexual gratification and being reckless as to whether the recipient will be caused alarm, distress or humiliation.
A sexually explicit deepfake.

Hidden advertising

Hidden advertising is not allowed on our site. This means you must not disguise advertising products or services as genuine User Content.

You must not upload, post or share content promoting services or web links to other sites in a manner that is misleading, deceptive or in breach of applicable advertising standards.

Property listings must accurately represent the property being advertised and must not contain misleading claims about the property, its features, price or availability.

Fake reviews

Fake reviews are not allowed on our site. Fake reviews include:

Reviews that conceal that the reviewer has been incentivised in some way to post the review.
Reviews that contain information that is false or misleading.
Reviews posted by a person who has not genuinely used the services or viewed the property to which the review relates.

If you post a review on our site, it must reflect your genuine experience and honest opinion. You must not post reviews about your own User Content or instruct others to post reviews on your behalf without disclosing that relationship.

Suspension and termination

If we determine that you have breached this acceptable use policy, we may take such action as we deem appropriate, including all or any of the following:

Immediate, temporary or permanent withdrawal of your right to use our site.
Issuing a warning to you.
Disclosing such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

How to report concerns

If you wish to report any User Content or use of our site that you believe breaches this acceptable use policy, or if you wish to report any other concern relating to content on our site, please contact us at [email protected].

We will review all reports and take such action as we consider appropriate in the circumstances. We will not be obliged to inform you of the outcome of any action we take.
